1. Agreement to these terms
These Terms of Use govern your access to and use of https://palestinetxmobilehomeleveling.com (the "Site"), operated by J&N Peak LLC. By accessing or using the Site, or by submitting information through any form on the Site, you agree to these terms. If you do not agree, do not use the Site.
2. Nature of the service
This site is an independent lead generation and referral service. It does not perform mobile home leveling work. All work is performed by independent local contractors who are solely responsible for their own licensing, insurance, workmanship and pricing.
To state this plainly and without qualification: Palestine TX Mobile Home Leveling is an independent lead generation and referral service. It does not perform mobile home leveling, pier repair, anchoring, skirting or any other construction, inspection or repair work. All work described anywhere on this Site is performed by independent contractors who are not employees, agents, partners or joint venturers of J&N Peak LLC.
Those independent contractors are solely and exclusively responsible for their own licensing, registration, insurance, bonding, permitting, workmanship, materials, scheduling, safety practices, warranties and pricing. J&N Peak LLC does not supervise, direct or control the work of any contractor, and does not perform, oversee, certify or guarantee any work.
No guarantee of work, pricing, availability, scheduling, quality or outcome is made. The submission of a form or a telephone call through this Site does not create any contractual relationship for services. Any agreement for work is between you and the contractor directly, and any dispute arising out of that work is between you and that contractor.
3. Information on the Site
Content on this Site is general informational material about manufactured home support systems, soils and site conditions in East Texas. It is not engineering advice, not a structural evaluation of your home, and not a substitute for an on site assessment by a qualified professional. Conditions vary from property to property, and nothing here should be relied on as a determination about your specific home.
4. Acceptable use
You agree that you will not:
- Use the Site for any unlawful purpose or in violation of any applicable law.
- Submit false, misleading or fraudulent information through any form.
- Submit information about another person without that person's authorization.
- Attempt to gain unauthorized access to the Site, its servers, or any connected system.
- Use any automated means to scrape, harvest, index or copy content or contact data from the Site.
- Interfere with, disrupt or place undue load on the Site or its infrastructure.

TO THE FULLEST EXTENT PERMITTED BY LAW, J&N PEAK LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT.
Without limiting the foregoing, no warranty is made that the Site will be uninterrupted, secure or error free, that content is accurate, current or complete, or that any contractor referred through the Site will be available, suitable, licensed, insured, competent or satisfactory. You are responsible for verifying the credentials, licensing, insurance and references of any contractor before engaging them.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, J&N PEAK LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY REFERRAL MADE THROUGH IT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF J&N PEAK LLC ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED UNITED STATES DOLLARS OR THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW, WHICHEVER IS GREATER.
J&N Peak LLC is not liable for the acts, omissions, negligence, work quality, damage, delay, injury, pricing or conduct of any independent contractor, whether or not that contractor was referred through this Site.
8. Indemnification
You agree to indemnify, defend and hold harmless J&N Peak LLC and its members, managers, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable attorney fees, arising out of your use of the Site, your violation of these terms, or your dealings with any contractor referred through the Site.
9. Third party links and services
The Site may contain links to third party websites, resources or services. Those links are provided for convenience only. J&N Peak LLC does not control and is not responsible for the content, accuracy, privacy practices, availability or offerings of any third party site, and inclusion of a link does not imply endorsement. Your use of any third party site is at your own risk and subject to that site's own terms.

These Terms of Use and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Texas, without regard to its conflict of law provisions.
